Terms of Service

1. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the information you provide, for keeping your account credentials secure, and for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without authorization.

2. Acceptable use

You may use Serpfeed only for lawful marketing and link-building activity relating to websites and brands that you own or are authorized to represent. You agree not to use the Service to send spam or deceptive communications, to impersonate any person or organization, to infringe intellectual property or privacy rights, to violate any applicable law, or to circumvent the access controls, rate limits, or usage policies of any third-party website. You are solely responsible for the content you create, upload, or transmit through the Service and for ensuring you have the rights to do so.

3. Outreach sent on your behalf

Serpfeed helps you draft and send outreach relating to your link-building campaigns. Outreach is always sent from an identity you provision and control (such as your own mailbox or sending domain), never from a Serpfeed domain. You are the sender of record. You are responsible for the content of your outreach and for complying with all applicable anti-spam, electronic marketing, and data protection laws (including, where applicable, the CAN-SPAM Act, the GDPR, and the ePrivacy rules), including honoring opt-out and unsubscribe requests.

4. Automated form and directory submissions

The Service includes features that, at your request and on your instruction, complete and submit web forms and directory listing applications on third-party websites using information from your project (such as your business name, website, description, and contact details). This is an important section, please read it carefully.

When you ask Serpfeed to fill in or submit a form for you, you are directing us to act as your agent and to transmit that information to the third-party website on your behalf, exactly as if you had entered and submitted it yourself. Each such submission is initiated by your explicit action or by an automation setting you have expressly enabled.

You acknowledge and agree that you are solely responsible for:

(a) the accuracy, legality, and completeness of the information submitted; (b) confirming that you have the right to submit that information and that doing so does not infringe anyone's rights; (c) ensuring that submitting to a given website is permitted by that website's terms of use, submission guidelines, and applicable law; and (d) any consequences, obligations, or communications that result from a submission made at your request.

Serpfeed acts only as a tool that carries out your instructions. We do not review, endorse, or independently verify the information you direct us to submit, and we are not a party to any relationship between you and the third-party website. We do not defeat or bypass security measures: we do not solve CAPTCHAs, and we do not automatically accept "I agree to the terms" or similar consent checkboxes on your behalf. Where a submission requires such a step, it is left for you to complete manually. You are responsible for reviewing any terms a third-party website asks you to accept.

5. Credits, plans, and billing

Some features consume credits or require a paid plan. Paid plans are billed in advance on a monthly or yearly basis through our payment processor. You can upgrade, downgrade, or cancel at any time from your account; cancellation stops future renewals and takes effect at the end of the current billing period. Except where required by law, fees already paid and credits already granted are non-refundable, and unused credits do not carry a cash value. We may change plans, prices, or credit allowances on a prospective basis with reasonable notice.

6. Third-party services and integrations

The Service integrates with third-party platforms (for example search, analytics, and email providers, and services you connect such as Google or social accounts). Your use of those platforms is governed by their own terms and policies. We are not responsible for third-party services, and your connection to them is at your own discretion. You are responsible for maintaining any credentials or authorizations you grant.

7. Intellectual property

The Service, including its software, design, and content we provide, is owned by Serpfeed and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You retain ownership of the content and data you provide, and you grant us the rights needed to host, process, and transmit it in order to operate and improve the Service.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific search rankings, traffic, that any link will be placed, that any listing or submission will be accepted, or that outreach will receive a response. Marketing results depend on many factors outside our control.

9. Limitation of liability

To the maximum extent permitted by law, Serpfeed will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold Serpfeed harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your content, your outreach, the information you direct us to submit on your behalf, your use of the Service, or your violation of these Terms or of any third-party rights or website terms.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that creates risk or legal exposure for us or others. Provisions that by their nature should survive termination (such as ownership, disclaimers, limitations of liability, and indemnification) will survive.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law rules. The courts located in the Netherlands will have jurisdiction over any dispute, except where mandatory consumer-protection law entitles you to bring proceedings in your place of residence.
